  San Diego DUI Laws and Consequences

The state of California has two types of statues that are used to determine how an individual will and can be charged for a DUI.  They are as follows:

The first statute compares the individual who is driving under the influence with that of a sober individual.  This regulation concludes whether or not the accused individual is more or less impaired that a sober person would be in that situation.  This decision is made by the officer who pulls a person over for  driving under the influence and it has nothing to do with blood alcohol content.

The second statute deals with the blood alcohol content or BAC.  in San Diego and all over the state of California an individuals blood alcohol level must be less than a .08%.  A driver can be arrested for exceeding this limit regardless of their capability to operate a vehicle and / or pass field sobriety tests.

  California DUI Laws - Third Drunk Driving Offense

  An Overview of California DUI Laws - Second Drunk Driving Conviction

If you have been charged with your second DUI offense in San Diego, CA you may be facing serious consequences.  If you have a prior conviction on your record and are charged with another DUI within a ten year period you may suffer serious consequences.  Multiple DUI convictions may included any or all of the following penalties:

  1. Jail - You could serve anywhere from 90 days to a year in prison.

  An Overview of California DUI Laws - First Drunk Driving Conviction

If you live in San Diego and you have been charged with a first time DUI offense there are a few things you should consider about the consequences of your pending conviction. 

First DUI Conviction:

California criminal law states that an individuals first drunk driving conviction could consist of, but is not limited to, the following DUI penalties:

  1. Jail - You could serve any where from 96 hours to 6 months in a San Diego jail. 
  2. Fines - You face the possibility of fines ranging from $390 to $1000 
  3. Suspended License - Your license will be suspended for six months. 
  4. Driving School - You will have to complete a "Driving Under the Influence" program in a San Diego driving school before you can drive again.
  5. Insurance - In some cases the price of your insurance will increase and your insurance plan will reflect your conviction.  Also, a special kind of insurance is required for a restricted license.
  6. IID - There is a possibility that you could be ordered to install an Ignition Interlock Device.  Sometimes you are required to purchase the expensive machinery from your local San Diego police department.
