Carjacking: Criminal Charges and Penalties

Carjacking is a criminal offense that involves taking another's motor vehicle by force, fear or threats of injury. Following are the key components of a carjacking case in San Diego:

  • The defendant took a motor vehicle that did not belong to him or her;
  • The defendant took the vehicle with the intent of temporarily or permanently depriving its owner of its use or possession;
  • The defendant took the vehicle from the immediate presence of the owner, a passenger in the vehicle or other person who was in possession of the vehicle; and
  • The defendant took the vehicle by way of force or fear.

The prosecuting attorney must prove all of these factors in order to secure a conviction for carjacking. If convicted, a defendant may face 3, 5 or 9 years in state prison. Additional penalties may apply if the defendant caused injury to a victim or used a firearm or other deadly weapon. Because it is a violent crime and a felony offense, carjacking will count as a "strike" on a defendant's record.
