About Drug Crimes & Penalties in California

Drug crimes involve a number of various criminal offenses that are all related to controlled substances, whether they are illegal narcotics or prescription drugs. The penalties for a drug crime conviction in San Diego County will vary greatly from case to case, primarily based upon the type of offense (possession, sale, distribution, trafficking, possession and cultivation of marijuana) as well as the type of drug and the amount. Controlled substances are categorized into "schedules," with a Schedule I substance considered the most dangerous and addictive. Accordingly, the penalties associated with Schedule I drugs (LSD, heroin, cocaine) are significantly worse than those involving less dangerous Schedule II, III or IV drugs.

Although some drug crimes are considered relatively minor and may result in a virtual "slap on the wrist," a conviction for any drug offense can come back to haunt you. Even a simple marijuana possession charge may affect employment and educational opportunities. A conviction for a more serious offense such as drug sale or distribution may result in mandatory imprisonment in county jail or state prison. If you are convicted of a drug offense involving trafficking large amounts of narcotics, you can expect to face up to 20 years or even life in prison.
