Murder/Manslaughter
San Diego Criminal Defense Attorney
If you or someone you know has been accused of taking another person's life, this is one of the most serious legal situations that you may face. Murder and manslaughter are most often charged as felonies and will result in a "strike" on your criminal record upon a conviction. Depending on the particular case, a person charged with first degree murder may even face the death penalty.
When your future and possibly your life are on the line, be sure that you work with a criminal defense lawyer who can provide you with the aggressive and dedicated legal counsel you deserve. At Superior Law Center we represent clients throughout San Diego County in the face of the most serious criminal charges, including murder and manslaughter.
Murder and Manslaughter in San Diego County, California
In California, there are four main types of criminal homicide for which a person may face charges:
- First Degree Murder - 25 years to life in prison
- Second Degree Murder - 15 years to life in prison
- Voluntary Manslaughter - 3 to 11 years in prison
- Involuntary Manslaughter - 2 to 4 years or up to 12 months imprisonment
First degree murder is the most serious of the four and involves intentional, preplanned homicide with malice aforethought. Second degree murder is similar to first degree murder but does not involve premeditation or preplanning. Manslaughter is a criminal homicide committed without malice or premeditation. Additionally, California observes the "felony murder rule" which classifies any homicide, even accidental, during the commission of a felony as first degree murder.
