Frequently Asked Questions

San Diego Criminal Defense Attorney

If you have been arrested or are facing any type of criminal law matter, you probably have numerous questions about your case, your rights, your options and what may be at stake. We have listed several frequently asked questions on this page to help address your concerns, and we will also be happy to discuss your case with you if you contact our firm.

When should I involve an attorney? It is a wise decision to involve an attorney as early in the criminal process as possible, even if charges have not yet been formally filed against you. From the moment you are accused of a crime or are under investigation by law enforcement, your rights are at stake and you may risk facing criminal charges at any moment. In some cases, an attorney being involved before charges are filed against you can help ensure they are not filed at all.

What is the difference between a felony and a misdemeanor? A felony is a more serious offense than a misdemeanor, and these are classified depending upon the potential penalties that may be imposed upon a conviction. A felony is typically punishable by a minimum of 1 year in state prison, while a misdemeanor is punishable by up to 12 months in county jail.

What is a "three strike crime"? California implements a particular law that mandates enhanced sentences for individuals convicted of more than one serious or violent felony offense. Under the Three Strikes Law, a second "strike" (serious or violent felony) will result in double the penalties imposed, and a third strike will result in a mandatory sentence of 25 years to life imprisonment.

What types of cases does your firm handle? Superior Law Center represents defendants throughout San Diego County in the face of all types of criminal charges, from DUI all the way to murder. We handle cases involving drug crimes, theft, sex crimes, federal crimes, juvenile crimes, domestic violence, weapon charges, probation violations and much more.

Is there anything I can do to clear an arrest or conviction from my criminal record? Expungement may be an option if you already have a criminal record, and during this process your lawyer would file a petition to have your criminal record sealed or cleared. To find out if you may qualify for expungement, contact our firm for a case evaluation.
